Thank you for visiting PLAD TECH, a product from A-1 Distributing, LLC (“Company,” “we,” “us,” or “our”). This Terms of Use (“Terms”) document governs your access to and use of our website located at https://www.pladtech.com/ (the “Site”), including any content, functionality, and services offered on or through the Site.

Please read these Terms carefully before using the Site. By accessing, interacting with, and using the product information, company information, webforms, account login methodologies, and any other information contained within the web pages of the Site, you accept and agree to be bound by these Terms. These Terms apply to your access to and use of the Site and do not alter in any way the terms and conditions of any other agreement you may have with Company for products, software, services or otherwise, unless otherwise directed by Company.

  1. Acceptance of Terms

By accessing the Site, you represent that you are at least 18 years of age and possess the legal authority to enter into these Terms. If you do not agree to these Terms, you must not access or use the Site.

  1. Intellectual Property Rights

The Site and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by the Company, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You are permitted to use the Site for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Site without our prior written consent.

  1. User Accounts and Security

To access certain features of the Site, such as your account page, you may be asked to provide certain registration details or other information.

  • You must treat your username, password, and any other piece of security information as confidential.
  • You agree to notify us immediately of any unauthorized access to or use of your username or password.
  • We have the right to disable any user account at any time in our sole discretion for any or no reason, including if, in our opinion, you have violated any provision of these Terms.

The Site provides a webform, phone number, and email address for you to contact us. By submitting information through any of these methods, you agree that all information you provide is governed by our Privacy Policy, and you consent to all actions we take with respect to your information consistent with that policy.

  1. App Store Links

The Site contains links to third-party platforms (such as the Apple App Store or Google Play Store) where you may download our product’s application. We do not control these third-party platforms and are not responsible for their availability, content, or the terms and conditions governing your use of those platforms.

When you use any PLAD TECH products or services, or send emails, text messages, and other communications from your computer or mobile device to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you in a variety of ways, such as by email, text, in-app push notices, or by posting notices and messages on this site. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

  1. Disclaimer of Warranties

YOUR USE OF THE SITE IS AT YOUR OWN RISK. THE SITE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. NEITHER THE COMPANY NOR ANY PERSON ASSOCIATED WITH THE COMPANY MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY, OR AVAILABILITY OF THE SITE.

  1. Limitation of Liability

TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO EVENT WILL THE COMPANY, ITS PARENT COMPANIES, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SITE, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED USD $250.

  1. Governing Law and Jurisdiction

All matters relating to the Site and these Terms, and any dispute or claim arising therefrom or related thereto, shall be governed by and construed in accordance with the internal laws of the State of Utah without giving effect to any choice or conflict of law provision.

Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Site shall be instituted exclusively in the federal courts of the United States or the courts of the State of Utah, in each case located in Salt Lake City, Salt Lake County.

  1. Changes to the Terms

We may revise and update these Terms from time to time in our sole discretion. All changes are effective immediately when we post them. Your continued use of the Site following the posting of revised Terms means that you accept and agree to the changes.
